Sir,

        At 1800 hours on the 16th April, 1945, a letter was received from No.1 DET. ALLIED REPATRIATION UNIT (INDIAN WING), asking that an interview be arranged with No. 9675 HAVILDAR MOH'D BAKHSH who states that four Indian prisoners of war were shot by the Germans at a prison Camp in France.

        As this incident might prove to be a War Crime at 1000 hours 17th April, 1945 I interviewed and obtained a statement from HAVILDAR MOH'D BAKHSH. From this statement the facts of this shooting would appear to be as follows:-

        On the 30th January, 1942, MOH'D BAKHSH was captured together with about a half of his regiment (4/16 PUNJAB REGIMENT) at BENGHAZI in AFRICA.

        After capture he was sent to Italy and after being confined in various prison camps in that country, he was sent to Germany.

        Whilst at a prison camp in MESSERICZ, he and other Indian prisoners received a lecture from S/C BOSE, who is apparently an Indian Congress leader now in whole hearted cooperation with the German Forces. The text of this lecture was that all Indian prisoners should join an organisation called the Free Indian Legion and fight alongside the German Forces.

        Indian soldiers attending this lecture refused to join this organisation, and all N.C.Os. were locked in a room, where they remained for 7 days receiving meals every alternate day, and without bedding.

        On release MOH'D BAKHSH refused to have anything to do with the Free Indian Legion, and he was sent with others to the punishment camp at MÜHLBURG where they were badly treated.

        After being moved from camp to camp he, in August, 1944, was in a prison camp in EPINAL, near NANCY in FRANCE, and one day he does not remember the date, but the time would be about 1600 hours, seven Indian prisoners escaped through the prison cage wire.

        Three of these men made good their escape, but the other four were recaptured, and were later shot, at some point outside the prison camp by the German guards.

        Later the bodies of these men were exhibited to the other prisoners, who were told that the same fate would befall them, if they attempted to escape.

        MOH'D BAKHSH states that he knew three of these men well, but he later learned the name of the fourth man from a fellow prisoner.

        The names of these men are as follows:-

        HAVILDAR MOH'D BAKHSH was later transferred to a prison camp in SUGAN in south east Germany where on the 16th February, 1945, all prisoners were liberated by the Russian Army.

        I have questioned MOH'D Bakhsh but he is unable to give any information respecting the prison guards who carried out the shooting, or the name of the Commandant of this Prison Camp.

        Enquiries made at No.1 Det. Allied Repatriation Unit reveal that MOH'D BAKHSH is the only person now in that unit to have any knowledge of the shooting of the four Indian prisoners.

        A copy of the statement made by HAVILDAR MOH'D BAKHSH is attached to this report.

STATEMENT OF:-

        No.9675 HAV MOH'D BAKHSH,

        4/16 PUNJAB REGIMENT.

WHO STATES:-

        On the 30th January, 1942, I was taken prisoner at BEHGHASI in AFRICA, together with about half of my regiment.

        After capture I was sent to various prison Camps in Italy, and later to a prison camp in Germany.

        Whilst at a prison camp in MESERICZ in Germany, we were lectured by S/C BOSE, who wanted us to volunteer for the Free Indian Legion, and fight alongside the Germans.

        After our refusal to join this Legion, all N.C.Os. were locked away in a room for 7 days receiving meals every alternate day, and we were without bedding.

        On our release I still refused to have anything to do with the Free Indian Legion, and I was transferred to another prison camp in Germany, at the town of MÜHLBURG, a punishment camp where we were all badly treated, receiving very little food, and where we were made to stay in the open, all day with very little clothing.

        After about 6 months in this camp, I was transferred to another camp, and various other camps after that.

        In August, 1944, I was in a camp at EPINAL near NANCY in FRANCE, and one day, I can't remember the date, but the time would be about 1600 hours, seven Indian prisoners escaped through the wire prison cage.

        Three of these men escaped completely, but the other four were recaptured, and shot, somewhere outside the cages. Their dead bodies were later brought into the Camp, and exhibited, and we were told that the same thing would happen to any other person who tried to escape.

        Three of the men who were shot I knew well, but the name of the fourth man I later learned from another prisoner, the names of these men are:-

        I was later transferred to SUGAN in south east Germany, where on the 16th February, 1945, I was released together with other prisoners by the Red Army.

        I have had the above statement read over to me in Urdi it is correct and true.

SHORT STATEMENT OF FACTS.

        On the afternoon of the 15th July, 1944, 15 men attempted to escape from the camp, succeeding in cutting through the wire and taking to the forest. The four above mentioned men together with two others were re-captured by a search party, the party commander of which made them stand in single file and ordered the 2nd accused to shoot at them, the first four men were shot dead.

 

PARTICULARS OF ALLEGED CRIME

        A roll call was held by the German Camp authorities at Stalag 315, Epinal, France, at approximately 1730 hours on the 15th July 1944, when it was found that 15 Indian prisoners of war had escaped from the camp: the men succeeded in cutting through the wire and had taken to the forest.

        Search parties were sent out and one party re-captured six men. The party commander made them stand in single file and ordered the second accused to shoot at them. The four foremost men were shot dead while standing with the arms raised but the remaining two men were spared. This occurred before 2000 hours as about that time the German Lager Fuhrer asked for the provision of 4 stretchers from the Infirmary; the bodies were brought back to the camp and were shown to the other prisoners of war who had been ordered to fall in.

        A note by the Indian Army Medical Officer at the Camp gives the cause of death in all four cases as "Bullet penetrating vital organs".

        The above mentioned men tried to escape from the camp along with 11 other men. The party succeeded in cutting through the wire and took to the forest. All the while the German sentinel on the post was present on his duty. After a considerable time the alarm was given and the German soldier went in pursuit of the fled aways. Three men were recaptured in the woods and were brought back in the Camp after being thrashed.

        The above mentioned men were caught by another search party of the same Camp along with two more men. The party commander made them in single file and ordered the German soldier to shoot at them. The foremost four men were shot down dead at close range while they were standing with up hoisted arms. The remaining two men of the file were spared on the party commander's own account.

        The survivors were brought back into the camp and after them followed the four stretchers carrying four dead bodies. The Camp was called out for roll call and the corpses were shown to the whole camp. The then Camp Senior asked the Camp authorities the cause of their death. The Camp Commandant told him that those men offered a resistance while being recaptured and that they were obliged to shoot them. When the Camp Senior asked the facts from the two survivors he was told that all the six men including them both were recaptured quite easily and no resistance was offered from their side.

        The eye witnesses have escaped again and we cannot produce them bodily as witnesses.

        The burial ceremony of the above mentioned P.O.Ws. was not given according to the Article 76 of the Geneva Convention of July 27, 1929.

        The Medical Officer who saw the wounds on the dead bodies is present in the Stalag now.

        I think it my foremost duty to bring the case in your sight hoping you will pay due attention to this matter.

Sir,

        I beg to inform you that a roll call was held by the German Camp authorities on 15th July at about 17.30 hrs at which the German authorities found that 15 Indian prisoners of war had escaped from the prisoners of war camp. In due course of this roll call 5 men out of them having been recaptured were brought back to the camp imprisonment cells.

        At about 20.00 hrs German Lager Fuhrer asked for the provision of 4 stretchers from the camp infirmary to fetch the four dead bodies of Indian prisoners of war who were shot dead by the Germans after their escape of the above 15 men.

        When the dead bodies of these four men were brought back to the camp, all prisoners of war were ordered to fall in, and the German Camp Fuhrer placed these bodies before all the Indian prisoners of war. After this I applied to see the dead bodies which was granted by the German Camp Fuhrer.

        1. Suchet Singh, P.O.W. No. 74158. His body was identified by the Man of Confidence Bhagat Ram, P.O.W. No.197. Gun-shot wound - Bullet entered through the cardiac region of the left side of the sternum and came out by the left side of the spinal column.

                Cause of death: Bullet penetrating vital organs.

        2. Lakshman Khote, P.O.W. No. 4671. His body was identified by Hav. Maj. Tukaram Dalvi, P.O.W. No. 1654. Gun-shot wound - Bullet entered just lateral to the right nipple, and came out through the left posterior axillary fold.

                Cause of death: Bullet penetrating vital organs.

        3. Gulam Ahmen P.O.W. No.72770. His body was identified by Mohd Ashgar, P.O.W. No. 8942. Gun-shot wound - Bullet entered through the liver region and came out through the left side of the back just below the ribs.

                Cause of death: Bullet penetrating vital organs.

        4. Nobat Shah, P.O.W. No/ 4915. His body was identified by Mohd Ashgar, P.O.W. No. 8942. Gun-shot wound - Bullet entered right of the chest in the posterior axillary line, and came out through the left side of the chest in the mid-axillary line.

                Cause of death: Bullet penetrating vital organs.

PARTICULARS OF EVIDENCE IN SUPPORT

 

        It may prove difficult to identify the accused but it is likely that an inquiry was held and if reference can be made to the proceedings, the two men could be identified in that way.

        The only evidence at present available consists of the attached reports from the Camp Leader and the Indian Man of Confidence dated respectively the 8th November 1944 and the 28th July, 1944.

        The two eye-witnesses have escaped again and it is not known where they are at present.

 

NOTES ON THE CASE

 

        The action of the 1st accused appears to have been taken on his own initiative. The 2nd accused was obeying the orders of the 1st accused; that is not a defence but may mitigate the punishment.

        The defence has been hinted at in a statement made by the German Camp Commandant to the effect that the men offered resistance while being recaptured and that it was necessary to shoot them. It will be observed however from the report of the Camp Leader that the two survivors stated that all six men were recaptured easily and that no resistance was offered.

        The case is reasonably complete in that it is a clear case of murder but there is at present no evidence on oath and it will be most desirable to have the evidence of the two eye-witnesses who survived.

        The medical evidence, on further enquiry, might tend to disprove the German contention.

        1. This department is investigating the above case with a view to bringing the Germans responsible to trial as war criminals.

        2. The facts are shortly as follows:- Six Indian POWs. escaped from Frontstalag 315 and were recaptured; they were then lined up and a German soldier shot at them; four fell dead but two survived.

        3. The two survivors have now been recovered and POW Dept., India Officer have informed this officer that they may now be at your camp. Their names are:- 1453 Cpl Tabiat Singh and 2619 W.O.II Lochrim Singh (British equivalent ranks only are known).

        4. I should be much obliged if you would inform me whether these men, or either of them, are at your camp; if so, whether they have made statements and whether you can provide this office with a copy of such statements. If they are at your camp but have not been interviewed, whether you can grant facilities for an officer from J.A.G's Branch, Eastern Command to interview them at the camp.

        Witness saw some Rs.700/- (in Egyptian & Indian currency) forcibly taken from an Indian Soldier (Hav.Dattaram Khanvilkar, 1/5th Mahratta L.I.) by a German Sentry; Witness reported the matter, but no action was taken and no receipt given.
